In tort, unliquidated damages are usually the most common remedy. Unliquidated damages are those damages in which the amount or extent has not been predetermined. In tort, the plaintiff who suffers any harm from the wrongful act of the defendant can bring an action which does not arise out of a contract. Although action for unliquidated damages is by no means the only remedy for a tort, it is one pretty sure test of tortious liability.
