West Bengal OBC List Controversy

The West Bengal government is currently engaged in legal and administrative process concerning the Other Backward Classes (OBC) list. This follows a Supreme Court directive to update the list amid allegations of political bias. The controversy primarily revolves around the inclusion of Muslim communities in the OBC list, which has raised questions about the criteria used for their inclusion.

Background

In 2010, the West Bengal government added 77 communities to its OBC list. Of these, 75 were Muslim communities. This decision faced backlash, leading to a legal challenge. In May 2024, the Calcutta High Court deemed the list illegal, stating that religion appeared to be the sole factor in the additions. The court ordered the West Bengal Commission for Backward Classes to prepare a new list.

Supreme Court’s Involvement

The West Bengal government appealed to the Supreme Court after the High Court’s ruling. On March 18, 2025, the state informed the court of its intention to conduct a fresh survey to reassess the OBC list. The Supreme Court granted the state three months to complete this task. The court has emphasised that reservation benefits cannot be based solely on religion.

The West Bengal government follows a three-tier process to include communities in the OBC list. This involves applications from communities, field surveys, and hearings conducted by the West Bengal Commission for Backward Classes.
