The challenge is merely political and not judicial as many legislators are completely ignoring it to change parties. The defection was seen by the makers of the Constitution as a vital menace to the stability of the democratic government.
The law was framed to dismiss any legislator is he voluntarily gave up membership of his party. The legislator will not face dismissal only if his party either merges with another party or two-thirds members of the legislators have agreed to the above. There have been an increased number of defections in recent years with little heed to the law. The latter does not hold good for democracy.
