UAE declared ‘Reciprocating Territory’ by India
Indian expatriates if convicted in a civil case in the UAE would no longer be able to seek safe heaven back in India as the Ministry of Law and Justice, Government of India during the second week of January 2020 issued an Extraordinary Gazette Notification, which declared the United Arab Emirates (UAE) to be a “reciprocating territory” under Section 44A of the Civil Procedure Code, 1908. The notification also declared a list of courts in the UAE to be ‘Superior Courts’ under the same section of CPC.
The orders passed by certain designated courts from a ‘reciprocating territory’ can be implemented in India as if they were passed in India. Besides UAE, the other countries which were declared as reciprocating territories include the United Kingdom, Singapore, Bangladesh, Malaysia, and New Zealand among others. The decision is believed to help bring down the time required for executing verdicts between the two countries. Apart from the Federal Courts of UAE (Federal Supreme Court and Federal First Instant and Appeal Court), six other Local courts were identified as Superior Courts.

March 24, 2025 at 7:34 amsir, if a bank in UAE provided loan facilities to a corporate company till 2015 and the become default for payments thereafter and the Bank filed a suit in 2017 and got a decree on the Company and its Personal& Corporate Guarantors in the year 2018 and the defendants are still contesting the matter as on date (March, 2025) in UAE courts. However, in the year 2021, the Bank has assigned its rights of the above defendants to a third party of UK based company without the consent of any defendants and the said assignee has filed a civil case in indian courts in March, 2024. Is the Assignee has right to file the Execution Petition in India in 2024 with respect to the Indian Govt. Gazette Notification dated 17th January, 2020 under India – UAE Bilateral Agreement?
