Jharkhand Domicile Bill-Update

The Jharkhand Government passed the Domicile Bill and the bill was sent to the governor for his assent. The governor refused to sign the bill. According to the Governor, the bill fails to provide equal employment opportunities to all the people in the state of Jharkhand. The bill says that only local persons can be appointed in Class 3 and Class 4 state government positions.

What is Domicile Bill?

The bill defines the “Local People” in the state of Jharkhand. The definition was framed based on 1932 land records. Also, the bill states that only the local people can be appointed to the positions of Class 3 and Class 4 state government posts.

What is the Governor saying?

Ramesh Bais is the current governor of Jharkhand state. Bais says that Article 16 guarantees equal employment opportunities to all Indian citizens. Appointing only the “local people” in state government posts violates the article.

Judicial citings

The Government cited apex court orders in support of his argument. The Narasimha Rao Vs Andhra Pradesh Government case was about employment opportunities for non-domicile persons in the state. The Andhra Pradesh Government relieved the non-domicile persons and replaced them with locals. The SC court condemned the actions of the AP government invoking Article 16.

In the Satyajit Kumar vs the State of Jharkhand state, the SC declared 100% reservation to the STs as unconstitutional.
