Indian judiciary : Landmark Judgements of 2014

2014 was an eventful year for Indian judiciary as it passed some landmark judgments which will go a long way in the Indian judicature.

Coal Block Cancellation

The SC cancelled 200 coal-blocks which had been allotted since 1993 after setting up a special court. One of the most pronounced judgement last year. It was based on a PIL Common Cause Vs. Government of India. The corporate lost Rs. 2 lakh crores as part of consequential investment.

National Tax Tribunal

SC in the Madras Bar Association Vs. Union of India gave a severe jolt to latter as it scrapped 2005 law which had set up a National Tax Tribunal to ease the pile of tax demands which are locked in litigation in high courts.

Arbitration and Conciliation

SC in the judgment of Enercon India Vs. Enercon Gm BN stood with the side of seat of arbitration for solving any dispute in only the related court and not any other venue. The seat will then make decision on the relevant court which has special jurisdiction to support the arbitration.

Sebi-Sahara dispute

The SC has sent signals for zero tolerance for any defiance of orders of the court ordered arrest of Subrata Roy and two of his directors to Tihar Jail.

CAG Audit for private telecom companies

SC gave ruling that all private players in Telecom sector which share revenue from natural resources with the government will now have to undergo CAG Audit.

Black Money

SC has taken an active step on the issue of bringing back the black money stacked in foreign banks. It also asked the government to make the names of the culprits.
