Family Courts (Amendment) Bill, 2022

Family Courts (Amendment) Bill, 2022 was passed in Lok Sabha on July 26, 2022. The bill granted statutory status to family courts set up in Himachal Pradesh and Nagaland. Bill has also validated all the actions taken by these courts.

Provisions of the Family Courts (Amendment) Bill 2022 includes;

  • Bill seeks to add a provision in sub-section 3 of section 1, for setting up family courts in Himachal Pradesh in effect from February 15, 2019 as well as in Nagaland effective from September 12, 2008.
  • It also seeks to add a new section 3A to validate all the action taken by these courts, retrospectively.
  • It will also validate the actions taken by Himachal Pradesh government and Nagaland government under the Family Court Act of 1984.
  • In Nagaland, two family courts were set up in 2008 and in Himachal Pradesh three family courts were set up in 2019.

Family Courts in India:

Family Courts Act 1984 was enacted to set up family courts in every district. Under the Act, State governments are mandated to set up family courts for every city or town with population more than one million. Thus, Law Minister Kiren Rijiju recently requested the state government across India to establish one family court in every district. In India, there are 715 family courts. Burden of pending cases has increased to 11,49,907 as of May 2022. Till May 2022, around 69,464 new cases have been registered while 75,386 cases have been resolved.
