Andhra Pradesh Bill to End Discrimination

The Government of Andhra Pradesh has introduced a Bill to amend the Dr. NTR University of Health Sciences Act, 1986 for removal of discriminatory terms regarding individuals affected by leprosy. The Bill was introduced on November 14, 2024, by Health Minister Satya Kumar Yadav.

Background on Leprosy

Leprosy, or Hansen’s disease, is caused by the bacteria Mycobacterium leprae. It primarily affects the skin, nerves, and mucous membranes. Advances in medical treatment have made leprosy curable. Multi-drug therapy (MDT) effectively renders the disease noncontagious after the first dose.

National Human Rights Commission Advisory

The National Human Rights Commission (NHRC) issued an advisory on January 14, 2022. This advisory aimed to eliminate discrimination against leprosy-affected individuals. The NHRC identified 97 laws needing amendment to achieve this goal. It found 20 discriminatory laws in Andhra Pradesh. The Dr. NTR University of Health Sciences Act was among these laws.

Legislative Changes Proposed

The proposed Bill will amend Sections 41(1)(a) and 42(2) of the Act. It will remove the terms “deaf-mute or suffering from leprosy.” This change aligns with the NHRC’s recommendations to ensure equal treatment for all individuals, regardless of their health status.

Rights of Persons with Disabilities Act

The Rights of Persons with Disabilities Act, 2016, mandates the removal of discrimination. It promotes equal opportunities for persons with disabilities. The Act includes provisions that support leprosy-cured individuals. The government is responsible for implementing these provisions effectively.

Government’s Commitment

The Ministry of Social Justice and Empowerment brought into light the need for change. In a letter dated October 13, 2023, it pointed out existing statutory provisions affecting persons with disabilities. The government’s decision to amend the Act reflects its commitment to inclusivity. This action aims to uphold the rights and dignity of all citizens.
