Maharashtra Prisons and Correctional Services Act, 2024

The Maharashtra assembly recently passed the Maharashtra Prisons and Correctional Services Act, 2024, aimed at modernizing the state’s prison system. This legislation is based on the 2023 Model Prisons Bill from the central government and introduces substantial reforms.

New Infrastructure Developments

The Act plans for a high-security prison in Mumbai and a two-storey facility in Pune. A land parcel has been secured for the Mumbai prison, enhancing the state’s capacity to manage inmates effectively.

Types of Prisons Established

The law categorizes prisons into various types, including special prisons, open prisons for women, and temporary prisons. Open colonies will facilitate the reintegration of former inmates into society.

The Act prioritizes rehabilitation over punishment, replacing the colonial-era Prisons Act of 1894. It introduces a Director General of Prisons and Correctional Rehabilitation, reflecting a modern approach to correctional services.

Improved Conditions for Vulnerable Groups

Provisions for women and transgender prisoners include enhanced facilities, accommodations, and security measures. The law aims to create a more inclusive environment within the prison system. To combat overcrowding, Under-trial Review Committees will be established. These committees will expedite the cases of inmates awaiting trial or those held for extended periods.

Modernisation of Prison Infrastructure

Plans include constructing multi-storey jails in high-density areas, adhering to international security and space standards. An Integrated Criminal Justice System (ICJS) will connect all jails, employing biometric identification and electronic monitoring.

The law emphasises inmates’ rights, instituting a grievance redressal system and establishing clear disciplinary guidelines. Emergency measures for riot control and natural disasters are also included to safeguard prisoner welfare.

Community and Societal Impact

Chief Minister Devendra Fadnavis brought into light that the reforms aim to create a better society. While ensuring basic human rights for prisoners, the Act does not promote luxurious conditions, focusing instead on humane treatment and rehabilitation.
