In modern times, keeping in view of considerable increase in the motor accidents the motor vehicles act provides for giving compensation immediately to the injured party and their basis rule of no fault liability. This does not affect the injured party’s right to getting higher compensation on the principle of fault under the ordinary law. This type of liability is known as strict liability as the defendant is held liable for the harm caused to the plaintiff without any fault.
